An early neutral evaluation is set in April for those involved in the complaint made by former Caliente City Clerk Jo Whitlock against some members of the Caliente City Council.

Attorney for Whitlock, Adam Levine, told the Record, “She stands in an excellent position. The Council members and the City violated her constitutional rights by terminating her without a pretermination hearing.”

It was understood by Levine that Councilmember JoLynn Cardinal was not named in the complaint because, “she was not a part of the decision, or voted against it,” he said.

In April, both sides will meet before a United States Magistrate judge, who will give an opinion on the relative merits of the case and try to reach a resolution.

Nick Crosby, representing the City of Caliente, would not comment on the complaint.
