At the Nov. 18 county commission meeting, attorney Shane Manuele of Ely resigned as Lincoln County conflict public defender

He was hired after then-public defender Dylan Frehner was elected county district attorney.

Manuele informed the commission that he is resigning because he has taken a position with the State Bar of Nevada in Las Vegas, beginning Jan. 1, 2019. He will be working under former Lincoln County District Attorney Daniel Hooge, now chief of the State Bar of Nevada.

With the change of employment, Manuele is having to close his private practice in Ely. Attorney Kristy Pickering, who has an established practice of her own, will take over Manuele’s practice.

Manuele recommended that the county commission hire Ms. Pickering to take over the remaining time on his contract with Lincoln County.

However, at the same meeting, attorney Matthew Carling of Cedar City, Utah, declared his interest in being hired to fill the remaining six months of the contract.

Carling said he has deep roots in Lincoln County. He served as assistant district attorney under former District Attorney Phillip Dunlevy, 1999-2001, and, for a time, when Daniel Hooge was district attorney.

Carling stated that he has current clients in Lincoln County, Cedar City, and Las Vegas.

“I know the nature of what happens with the conflict contract,” he said, “the types of cases, not just criminal cases, and my experience with Mr. Dunlevy and Mr. Hooge, has taught me immensely how to handle those types of cases. I work well with both Mr. Frehner and current public defender Mr. [Franklin] Katschke.”

Commissioners decided to have both parties come in and present their cases at the Dec. 3 commission meeting.
